Terms that apply to use of the FireDash public and partner APIs through the Developer Portal.

These FireDash API Terms of Use ("API Terms") govern your access to and use of the application programming interfaces, software development kits, sample code, documentation, and related resources made available at developer.firedash.us and through the FireDash Developer Portal (collectively, the "API"). The API is part of the FireDash family of Services operated by Wrights Creative Services, L.L.C. ("FireDash", "we", "us", or "our").
By accessing or using the API, you ("Developer", "you") agree to be bound by these API Terms, the FireDash Terms of Service, and the FireDash Privacy Policy, each of which is incorporated by reference. If you are accessing the API on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these API Terms.
To use most endpoints, you must register for a developer account, create an application, and obtain an API key or OAuth client credentials. You agree to:
We may revoke API keys, suspend application access, or refuse to issue credentials at any time and for any reason, with or without notice, including for violation of these API Terms.
Subject to your compliance with these API Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license during the term to access and use the API solely to develop, test, and operate applications, integrations, or internal tools that interact with the Services in ways consistent with the documentation.
If your application accesses data that belongs to a FireDash customer (for example, a fire department), you must do so only with that customer's authorization, and only for the purposes that customer has authorized.
You agree not to, and not to permit any third party to:
We may impose rate limits, quotas, or other usage thresholds on the API and may change them at any time. You must comply with all published limits and respect Retry-After and similar headers. We may throttle, suspend, or revoke access if your usage threatens the stability of the Services, exceeds the limits associated with your plan, or appears abusive.
Data returned by the API may include (a) FireDash Content (owned by us or our licensors), (b) Customer Data (owned by the relevant FireDash customer, such as a fire department or agency), and (c) Resident Data (owned by the resident user, subject to the limited license described in the FireDash Terms of Service).
You agree to:
FireDash does not sell personal information, and you may not use the API to facilitate the sale of personal information.
You must maintain a reasonable information security program appropriate to the nature of the data you handle. If you become aware of any actual or reasonably suspected security incident involving the API, API-derived data, or your credentials, you must notify security@firedash.us without undue delay, and in any event within seventy-two (72) hours of discovery. You must cooperate with us in good faith to investigate and remediate the incident.
Subject to any brand guidelines we publish, you may identify your application as using or integrating with FireDash, provided that you do not imply endorsement or partnership that does not exist, and you do not use FireDash trademarks in your application's name, logo, or domain in a way that is likely to cause confusion. We may require attribution (for example, "Powered by FireDash") for certain features. All goodwill arising from your use of FireDash marks inures to us.
We may change, deprecate, or discontinue any part of the API at any time. Where reasonably practical, we will provide advance notice of breaking changes through the Developer Portal, the changelog, or a developer mailing list. You are responsible for monitoring those channels and updating your applications. Deprecated endpoints may be removed after a reasonable transition period.
Access to the API may be free up to certain limits and paid above those limits. Pricing, plan terms, and limits are described on the Developer Portal and may change. If you are on a paid plan, the billing terms in the FireDash Terms of Service apply.
If you provide feedback, suggestions, or ideas about the API or the Services ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that Feedback for any purpose, without attribution or compensation to you.
As between you and FireDash, we and our licensors retain all right, title, and interest in and to the API, the documentation, and the Services, including all related intellectual property rights. No rights are granted to you other than those expressly set out in these API Terms. The FireDash name and logo are our trademarks. Other trademarks identified through the API belong to their respective owners.
The API documentation, beta features, and any non-public technical information shared with you are our confidential information. You may use that information only as needed to integrate with the API and must protect it using the same standard of care you use to protect your own confidential information of similar sensitivity (and in no event less than a reasonable standard of care).
THE API IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE API WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT API DATA WILL BE ACCURATE OR COMPLETE. THE API IS NOT A SUBSTITUTE FOR EMERGENCY RESPONSE; IN AN EMERGENCY, CALL 9-1-1.
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE API, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY UNDER THESE API TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE API IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00 USD).
You will defend, indemnify, and hold harmless FireDash and its affiliates, officers, employees, and agents from and against any claim, loss, damage, liability, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your use of the API; (b) your application or its content; (c) your breach of these API Terms or applicable law; or (d) your infringement or misappropriation of any third-party right, including a third party's privacy rights.
We may suspend or terminate your access to the API at any time, with or without notice, for any reason, including (a) violation of these API Terms; (b) risk to the security, integrity, or availability of the Services; (c) request by a customer whose data you access; or (d) discontinuation of the API. You may terminate your use of the API at any time by ceasing to call the API and deleting your developer account. Sections concerning data ownership, confidentiality, disclaimers, limitation of liability, indemnification, and miscellaneous survive termination.
These API Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. The dispute resolution, arbitration, venue, and class-action waiver provisions of the FireDash Terms of Service apply to disputes under these API Terms.
We may update these API Terms from time to time. The updated version is effective when posted, indicated by a new "Last updated" date. Your continued use of the API after the effective date constitutes acceptance of the updated terms. For material changes, we will use reasonable efforts to provide advance notice through the Developer Portal or developer communications.
